By accessing or using the OriginStart AI platform and API services (the "Service") provided by PocketTreasure Limited ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

OriginStart AI provides an API gateway service that allows users to access various AI language models (including but not limited to Claude, GPT, Gemini, and DeepSeek) through a unified API interface. We act as an intermediary between you and the upstream AI model providers.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your API keys and account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account at info@originstart.ai.

4. Billing and Payment

• The Service operates on a prepaid credit basis. You must maintain a positive balance to use the API.
• Pricing is based on token usage as displayed on our pricing page and may be updated from time to time.
• All payments are non-refundable except for unused credits, which may be refunded at our discretion upon request.
• We reserve the right to modify pricing with reasonable advance notice.
• You are responsible for any applicable taxes related to your use of the Service.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use the Service to build a competing product or service
• Resell or redistribute API access without our prior written consent
• Exceed rate limits or abuse the Service in any manner

6. API Usage and Rate Limits

We may impose rate limits and usage quotas on your API access. Exceeding these limits may result in temporary throttling or suspension. We will make reasonable efforts to notify you of any applicable limits.

7. Intellectual Property

You retain all rights to the content you submit through the API. We do not claim ownership of your input or output content. The Service itself, including its design, code, and branding, remains the intellectual property of PocketTreasure Limited.

8. Service Availability and SLA

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service is provided on an "as is" and "as available" basis. We may perform maintenance, updates, or modifications that temporarily affect availability.

9. Limitation of Liability

To the maximum extent permitted by applicable law, PocketTreasure Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless PocketTreasure Limited, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, upon notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Any unused credits may be refunded at our discretion.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
